What Affirmative Action and MBS Have in Common

At first glance, the Supreme Court's 2003 decision in Gratz v. Bollinger, in which it upheld the University of Michigan's affirmative action admissions policy, has precisely nothing in common with a lawsuit accusing Goldman Sachs Group Inc. of misleading investors about the risks associated with mortgage securities offerings.
